Investors are required to provide a 30 business day notice before the end of the investment term if they intend to withdraw their investments. Failure to provide this notice will result in the automatic renewal of the agreement for a new term, with a minimum duration of 12 months.
5.2 Automatic Renewal
In the event that an Investor does not submit the required 30 business day withdrawal notice, the agreement will automatically renew under the same terms and conditions for an additional term of no less than 12 months. This renewal is binding, and the Client must adhere to the terms outlined in this Investment Policy.
5.3 Cancellation after Renewal or During Term
If an Investor wishes to cancel the agreement after renewal or during an active term, a 60 business day notice is required. This notice period is necessary to comply with SEC regulations concerning the sale, transfer, or dispensing of securities, allowing Zyva Capital sufficient time to manage the investment portfolio and redeem the maximum amount possible for the Investor.
5.4 Redemption Process
Upon receiving a valid cancellation notice, Zyva Capital will initiate the redemption process in compliance with SEC regulations. This process includes:
a. Evaluating market conditions and asset liquidity.
b. Selling or transferring securities as per regulatory guidelines.
c. Disbursing the redeemed amount to the Investor in accordance with the terms of the agreement.
